1. Definitions

  • Yes Travel / Agent: Refers to Yes Travel & Holidays Sdn. Bhd., a company incorporated in Malaysia.
  • Customer: Refers to the corporate entity, company, or organisation engaging the Agent’s services.
  • Trip: Refers to the travel itinerary and arrangements as described in the relevant quotation, including transport, accommodation, meals, activities, and all related services.

2. Contractual Framework

2.1. These GTC govern all services rendered by Yes Travel to the Customer.
2.2. By executing a Letter of Appointment and/or accepting a Quotation, the Customer acknowledges and agrees to be legally bound by these GTC.
2.3 These GTC supersede all prior discussions, drafts, and terms, and shall prevail over any conflicting customer purchase orders or documentation unless expressly agreed in writing by Yes Travel.
2.4 Yes Travel reserves the right to amend these GTC from time to time. Any amendments shall be effective upon written notice to the Customer. In the absence of any written objection within three (3) business days of such notice, the Customer shall be deemed to have accepted the amended terms.
2.5 These GTC shall take effect upon execution of the Letter of Appointment and shall remain in force and effect until the services are completed, terminated in accordance with the Termination provisions herein, or until the project is formally closed.
2.6 Notwithstanding the above, Yes Travel reserves the right to decline, suspend, or defer the provision of any services at its discretion, including due to ineligibility, failure to meet registration or credit requirements, unavailability of requested services, or non-compliance with these GTC or any applicable supplementary terms. Where services cannot be rendered, such requests may be retained for internal review and service improvement purposes.

3. Principal Terms of Engagement

3.1 Upon acceptance of the Quotation, whether by signing and returning the document, or through any conduct indicating assent, and execution of the Letter of Appointment:
a. Yes Travel is irrevocably authorised to commence work and secure bookings;
b. All costs incurred or committed by Yes Travel, whether or not expressly instructed again in writing, shall be fully payable by the Customer;
c. No cancellations shall entitle the Customer to avoid liability for actual and committed expenses;
d. All invoices issued by Yes Travel shall be deemed final and binding unless the Customer raises a written objection within three (3) business days from the date of receipt, clearly specifying the disputed item(s) and the grounds thereof. For the avoidance of doubt, only bona fide and properly substantiated disputes shall be considered, and Yes Travel reserves the right to reject any dispute deemed unreasonable, unsupported, or made in bad faith.

4. Customer’s Obligations

4.1 The Customer shall:
a. Provide accurate, timely, and complete information relating to the Trip, including confirmed participant details, special needs, travel schedules, budgets, and any additional information reasonably requested by Yes Travel for the purpose of planning, booking, or executing the services;
b. Notify Yes Travel in writing of any dietary, health, or accessibility requirements;
c. Ensure that all participants comply with applicable local laws, airline regulations, and any conduct guidelines issued by Yes Travel;
d. Fully cooperate with Yes Travel and act in good faith at all times;
e. Be solely responsible for any loss or damage arising from failure to provide accurate information or instructions.
